A BILL TO BE ENTITLED
 
AN ACT
  relating to treatment under the public school accountability system
  of an open-enrollment charter school that is operated by a juvenile
  board and that focuses on juvenile justice or corrections.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 12, Education Code, is
  amended by adding Section 12.136 to read as follows:
         Sec. 12.136.  ACCOUNTABILITY: CHARTER SCHOOLS OPERATED BY
  JUVENILE BOARD AND FOCUSED ON JUVENILE JUSTICE. (a) This section
  applies only to an open-enrollment charter school that is operated
  by a juvenile board and that focuses on juvenile justice or
  corrections.
         (b)  Academically, the mission of an open-enrollment charter
  school to which this section applies as provided by Subsection (a)
  is to enable students to perform at or above grade level. For
  purposes of accountability under Chapter 39, a student enrolled in
  the school is reported as if the student were enrolled at the
  student's assigned campus in the student's regularly assigned
  education program, including a special education program.
  Annually, the school, with the agreement of the commissioner, shall
  develop and implement a system of accountability consistent with
  Chapter 39, where appropriate, to assure that students make
  academic progress toward grade level while attending the school.
         SECTION 2.  This Act applies beginning with the 2009-2010
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
