A BILL TO BE ENTITLED
 
AN ACT
  relating to coordinating information regarding the location of
  infrastructure to which the supply of electric service is critical
  to the public health and safety or for emergency management
  purposes.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 418, Government Code, is amended by
  adding Subchapter I to read as follows:
  SUBCHAPTER I. CRITICAL SERVICE INFRASTRUCTURE INFORMATION FOR
  ELECTRIC TRANSMISSION AND DISTRIBUTION EMERGENCY RESPONSE
         Sec. 418.251.  CRITICAL SERVICE INFRASTRUCTURE INFORMATION.
  (a)  To provide for rapid mitigation of disasters or emergencies
  that result in widespread electric utility service outages, each
  municipality and county shall provide the division with the
  location of infrastructure in the municipality's or county's
  jurisdiction that is critical to the public health or safety and
  that requires electric utility service to adequately respond to or
  to mitigate the effects of a disaster or emergency.
         (b)  A municipality or county shall file with the division
  the critical infrastructure location information:
               (1)  annually;
               (2)  on a standardized form provided by the division to
  be filed electronically or by mail; and
               (3)  by street address and by any other means of
  identifying location the division requires.
         (c)  The division shall provide with the standardized form
  information to assist a municipality or county in determining the
  infrastructure in the municipality's or county's jurisdiction that
  is critical to the public health or safety and that requires
  electric utility service to adequately respond to or to mitigate
  the effects of a disaster or emergency. The municipality or county
  must rank the critical infrastructure identified on the form by
  priority.  The critical infrastructure identified must include:
               (1)  police and fire stations;
               (2)  relevant government buildings;
               (3)  sewage lift stations;
               (4)  water treatment facilities; and
               (5)  hospitals.
         Sec. 418.252.  DISTRIBUTION OF INFORMATION TO UTILITIES.
  (a)  The division shall provide to each electric utility that owns
  electric transmission and distribution lines the critical
  infrastructure location information for each municipality or
  county served by the utility. The Public Utility Commission of
  Texas shall assist the division in identifying the relevant
  utilities and coordinating the delivery of the information.
         (b)  The division shall provide the information annually
  under Subsection (a) not later than March 1.
         Sec. 418.253.  MAINTENANCE OF INFORMATION. (a)  An electric
  utility that receives the critical infrastructure location
  information from the division shall:
               (1)  maintain the information to assist the utility
  with efforts to restore electric utility service; and
               (2)  update the information annually with location
  information as it is received from the division.
         (b)  The Public Utility Commission of Texas shall adopt rules
  to ensure compliance with this section.
         SECTION 2.  This Act takes effect September 1, 2009.
