A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an exemption from certain end-of-course assessment |
|
instruments for a high school student earning college credit. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 39.023, Education Code, is amended by |
|
adding Subsection (o) to read as follows: |
|
(o) Notwithstanding Subsection (c) or Section 39.025, a |
|
student is exempt from the administration of an end-of-course |
|
assessment instrument otherwise required under Subsection (c) or |
|
Section 39.025 if the student receives college credit through a |
|
program implemented under Section 28.009 for a course in the |
|
subject area of the course for which the end-of-course assessment |
|
instrument was adopted. This subsection does not prohibit a |
|
student entitled to an exemption from electing to participate in |
|
the administration of an assessment instrument, provided that the |
|
student's performance on the assessment instrument in that |
|
circumstance is considered in the same manner as performance is |
|
considered for other students. The State Board of Education may |
|
adopt rules necessary to implement this subsection. |
|
SECTION 2. Section 39.023(o), Education Code, as added by |
|
this Act, applies beginning with a student who earns college credit |
|
during the 2010-2011 school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
