A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the criminal consequences of a refusal or failure to |
|
|
comply with certain rules and orders issued or entered by the |
|
|
commissioners court of a county in connection with the public roads |
|
|
of the county. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 251, Transportation Code, |
|
|
is amended by adding Section 251.018 to read as follows: |
|
|
Sec. 251.018. REFUSAL OR FAILURE TO COMPLY WITH RULE OR |
|
|
ORDER; OFFENSE. (a) A person commits a misdemeanor offense if the |
|
|
person refuses or fails to comply with a rule issued or an order |
|
|
entered by a commissioners court under this subchapter. |
|
|
(b) An offense under this section is punishable by a fine |
|
|
not to exceed $200. |
|
|
(c) If conduct that constitutes an offense under this |
|
|
section also constitutes an offense under any other law, the actor |
|
|
may be prosecuted under this section or the other law. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
