A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of private duty nursing and therapy |
|
|
services under the Medicaid program in accordance with |
|
|
authorization by a licensed nurse practitioner or a physician |
|
|
assistant. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 32.067, Human Resources Code, is amended |
|
|
by adding Subsection (c) to read as follows: |
|
|
(c) The department shall ensure that a licensed nurse |
|
|
practitioner or a physician assistant is permitted to authorize the |
|
|
provision of private duty nursing and therapy services to |
|
|
individuals through the Texas Health Steps Comprehensive Care |
|
|
Program, to the extent that a nurse practitioner or physician |
|
|
assistant is permitted to authorize those services under Chapter |
|
|
142, Health and Safety Code, Chapter 157, Occupations Code, or |
|
|
federal law. |
|
|
SECTION 2. If before implementing any provision of this Act |
|
|
a state agency determines that a waiver or authorization from a |
|
|
federal agency is necessary for implementation of that provision, |
|
|
the agency affected by the provision shall request the waiver or |
|
|
authorization and may delay implementing that provision until the |
|
|
waiver or authorization is granted. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
