A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the term of a municipal solid waste permit issued by the |
|
|
Texas Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|
|
Code, is amended by adding Section 361.0882 to read as follows: |
|
|
Sec. 361.0882. TERM OF MUNICIPAL SOLID WASTE PERMIT. (a) A |
|
|
municipal solid waste permit issued under this chapter is valid for |
|
|
a term not to exceed 10 years. |
|
|
(b) The commission may renew a municipal solid waste permit |
|
|
in the manner provided by Section 361.088. |
|
|
SECTION 2. (a) Section 361.0882, Health and Safety Code, |
|
|
as added by this Act, applies to a municipal solid waste permit |
|
|
issued before, on, or after the effective date of this Act. |
|
|
(b) As soon as practicable after the effective date of this |
|
|
Act, the Texas Commission on Environmental Quality by rule shall |
|
|
adopt procedures and a schedule for the renewal of municipal solid |
|
|
waste permits issued before the effective date of this Act. |
|
|
(c) The schedule adopted by the Texas Commission on |
|
|
Environmental Quality for the renewal of municipal solid waste |
|
|
permits issued before the effective date of this Act may allow for |
|
|
Section 361.0882, Health and Safety Code, as added by this Act, to |
|
|
be implemented over any period of time the commission considers |
|
|
necessary for administrative feasibility and effectiveness. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
