A BILL TO BE ENTITLED
 
AN ACT
  relating to the jurisdiction of certain courts in suits affecting
  the parent-child relationship.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 152.105, Family Code, is amended by
  adding Subsection (d) to read as follows:
         (d)  Notwithstanding any other provision of this chapter, a
  court of this state may exercise jurisdiction as if this state were
  the home state if a court in a foreign country has not provided a
  party notice and an opportunity to be heard in accordance with the
  standards of Section 152.108.
         SECTION 2.  The change in law made by this Act applies to a
  suit affecting the parent-child relationship that is filed on or
  after the effective date of this Act.  A suit affecting the
  parent-child relationship that is filed before that date is
  governed by the law in effect on the date the suit was filed, and the
  former law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2009.
