A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the jurisdiction of certain courts in suits affecting |
|
|
the parent-child relationship. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 152.105, Family Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) Notwithstanding any other provision of this chapter, a |
|
|
court of this state may exercise jurisdiction as if this state were |
|
|
the home state if a court in a foreign country has not provided a |
|
|
party notice and an opportunity to be heard in accordance with the |
|
|
standards of Section 152.108. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
suit affecting the parent-child relationship that is filed on or |
|
|
after the effective date of this Act. A suit affecting the |
|
|
parent-child relationship that is filed before that date is |
|
|
governed by the law in effect on the date the suit was filed, and the |
|
|
former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
