A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement that an applicant for registration of a
  vehicle provide proof that the vehicle has passed a compulsory
  vehicle inspection.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 502.1535, Transportation Code, is
  amended to read as follows:
         Sec. 502.1535.  EVIDENCE OF VEHICLE OR VEHICLE EMISSIONS
  INSPECTION. (a) A county assessor-collector may not register a
  vehicle subject to Section 548.051 unless proof that the vehicle
  has passed an inspection as required by that section, in a form
  authorized by that section, is presented to the county
  assessor-collector with the application for registration.
         (b)  A county assessor-collector may not register a motor
  vehicle subject to Section 548.3011 unless proof that the vehicle
  has passed a vehicle emissions test as required by that section, in
  a form authorized by that section, is presented to the county
  assessor-collector with the application for registration.
         SECTION 2.  Section 548.051, Transportation Code, is amended
  by adding Subsection (c) to read as follows:
         (c)  A vehicle subject to this section is not eligible for
  registration under Chapter 502 unless proof is presented with the
  application for registration that the vehicle has passed the
  inspection required by this section. The proof required by this
  subsection may be in the form of a Vehicle Inspection Report (VIR)
  or other proof of inspection as authorized by the department. A
  Vehicle Inspection Report or other authorized proof of inspection
  must include, in type larger than other type on the Vehicle
  Inspection Report or other proof of inspection, the following
  statement:
         "A motor vehicle may not be registered in this state on or
  after September 1, 2010, unless the applicant for registration
  provides proof that the vehicle has passed the inspection required
  by law. This document, or a copy of this document, is acceptable
  proof that the vehicle has passed such an inspection."
         SECTION 3.  (a) Except as provided by Subsection (b) of this
  section, this Act takes effect September 1, 2009.
         (b)  Section 502.1535(a), Transportation Code, as added by
  this Act, takes effect September 1, 2010.
