A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the regulation of signs by municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 216.901, Local Government Code, is |
|
|
amended to read as follows: |
|
|
Sec. 216.901. REGULATION OF SIGNS BY [HOME-RULE] |
|
|
MUNICIPALITY. (a) A [home-rule] municipality may license, |
|
|
regulate, control, or prohibit the erection of signs or billboards |
|
|
by charter or ordinance. |
|
|
(b) Subsection (a) does not authorize a municipality to |
|
|
regulate the relocation, reconstruction, or removal of a sign in |
|
|
violation of Subchapter A. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
