A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to consumer goods and services covered under the Texas |
|
|
Telemarketing Disclosure and Privacy Act. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 304.002(3), Business & Commerce Code, as |
|
|
effective April 1, 2009, is amended to read as follows: |
|
|
(3) "Consumer good or service" means property of any |
|
|
kind or a contractual service that is normally used for personal, |
|
|
family, or household purposes. The term: |
|
|
(A) does not include a security, as defined by |
|
|
Section 4, The Securities Act (Article 581-4, Vernon's Texas Civil |
|
|
Statutes); and |
|
|
(B) includes the extension of a warranty for a |
|
|
motor vehicle. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a call made on or after the effective date of this Act. A call |
|
|
made before the effective date of this Act is governed by the law in |
|
|
effect when the call was made, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
