A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to notice of the leave policies of a school district to |
|
district employees. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 22, Education Code, is |
|
amended by adding Section 22.008 to read as follows: |
|
Sec. 22.008. NOTICE OF LEAVE POLICY. (a) A school district |
|
shall provide written notice to any district employee regarding the |
|
types of leave the employee is entitled to while employed by the |
|
district. The notice must include: |
|
(1) an explanation of the district's policies |
|
regarding leave; and |
|
(2) a description of: |
|
(A) the personal leave the employee is entitled |
|
to as provided by Section 22.003; |
|
(B) the leave allowed for jury service as |
|
provided by Section 22.006; and |
|
(C) the leave allowed for complying with a |
|
subpoena as provided by Section 52.051(a), Labor Code. |
|
(b) If the employee is an educator certified under Chapter |
|
21, the notice must also include a description of leave allowed for: |
|
(1) observance of a religious holiday as provided by |
|
Section 21.406; |
|
(2) a temporary disability as provided by Section |
|
21.409; and |
|
(3) training and developmental purposes as provided by |
|
Section 21.452. |
|
(c) The notice required by this section must be given to a |
|
school district employee not later than the 10th day after the date |
|
the employee is hired by the district. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
