A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to venue for the prosecution and punishment of certain |
|
|
offenses committed on the boundaries of two or more counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 13.04, Code of Criminal Procedure, is |
|
|
amended to read as follows: |
|
|
Art. 13.04. OFFENSES COMMITTED ON THE BOUNDARIES OF |
|
|
COUNTIES. (a) An offense committed on the boundaries of two or |
|
|
more counties, or within four hundred yards of those boundaries |
|
|
[thereof], may be prosecuted and punished in any one of those [such] |
|
|
counties. This subsection does not apply to an offense committed |
|
|
under Subtitle E, Title 7, Transportation Code. |
|
|
(b) An [and any] offense committed on the premises of any |
|
|
airport operated jointly by two municipalities and situated in two |
|
|
counties may be prosecuted and punished in either county. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to venue for the trial of an offense committed on or after the |
|
|
effective date of this Act. Venue for the trial of an offense |
|
|
committed before the effective date of this Act is covered by the |
|
|
law in effect when the offense was committed, and the former law is |
|
|
continued in effect for that purpose. For purposes of this section, |
|
|
an offense was committed before the effective date of this Act if |
|
|
any element of the offense occurred before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
