A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to accountability of certain open-enrollment charter |
|
schools serving students at high risk of dropping out of school. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 12, Education Code, is |
|
amended by adding Section 12.137 to read as follows: |
|
Sec. 12.137. ACCOUNTABILITY OF CERTAIN OPEN-ENROLLMENT |
|
CHARTER SCHOOLS. (a) In this section, "student at high risk of |
|
dropping out of school" means a student who: |
|
(1) meets three or more of the criteria provided by |
|
Section 29.081(d); or |
|
(2) is at least 21 years of age but less than 26 years |
|
of age and otherwise meets at least one of the criteria provided by |
|
Section 29.081(d). |
|
(b) This section applies only to an open-enrollment charter |
|
school offering a high school curriculum in which 85 percent or more |
|
of the students enrolled in the school on the date specified by the |
|
agency are students at high risk of dropping out of school. |
|
(c) An open-enrollment charter school to which this section |
|
applies is not required to include the performance of a student at |
|
high risk of dropping out of school in any accountability report |
|
until the 180th day after the date the student first enrolls in the |
|
school. For purposes of this subsection, "accountability report" |
|
includes a report required under the academic excellence indicator |
|
system described by Section 39.051 or the performance-based |
|
monitoring analysis system. |
|
SECTION 2. This Act applies beginning with the 2009-2010 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
