A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authorizing a fee in bail bond forfeiture proceedings. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 133.154(a), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(a) In addition to other fees authorized or required by law, |
|
|
the clerk of a district court, statutory county court, or county |
|
|
court shall collect a fee of $42 on the filing of any civil suit or |
|
|
after the entry of a judgment nisi for the forfeiture of a bail |
|
|
bond. The fee is to be used for court-related purposes for the |
|
|
support of the judiciary. |
|
|
SECTION 2. The change in law made by this Act to Section |
|
|
133.154, Local Government Code, applies only to a bail bond that is |
|
|
executed on or after the effective date of this Act. A bail bond |
|
|
executed before the effective date of this Act is governed by the |
|
|
law in effect when the bail bond was executed, and the former law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
