A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the creation of a bail bond board by the commissioners
  court of certain counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1704.052, Occupations Code, is amended
  to read as follows:
         Sec. 1704.052.  DISCRETIONARY CREATION OF BOARD. A board
  may be created in a county with a population of less than 110,000
  if:
               (1)  a majority of the persons who would serve as
  members of the board under Section 1704.053, or who would designate
  the persons who would serve as members of the board, determine to
  create a board; and
               (2)  the commissioners court approves the creation of
  the board by a majority vote.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
