A BILL TO BE ENTITLED
 
AN ACT
  relating to the regulation of air conditioning and refrigeration
  technicians.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1302.101, Occupations Code, is amended
  by adding Subsection (f) to read as follows:
         (f)  The commission shall adopt rules under this chapter
  necessary to comply with Chapter 53.
         SECTION 2.  Section 1302.260(b), Occupations Code, is
  amended to read as follows:
         (b)  A license issued under this chapter is valid for one
  year from the date of issuance [expires at the end of the license
  period set by the commission].
         SECTION 3.  Subchapter F, Chapter 1302, Occupations Code, is
  amended by adding Section 1302.2601 to read as follows:
         Sec. 1302.2601.  RENEWAL OF LICENSE OR REGISTRATION. (a) On
  payment of the required fee, a license or registration under this
  chapter may be renewed annually.
         (b)  Notwithstanding Sections 51.401(c) and (d), a person
  whose license or registration has been expired for more than 90 days
  but less than two years may renew the license or registration by
  paying to the department a renewal fee that is equal to two times
  the normally required renewal fee. A person whose license or
  registration has been expired for two years or more may not renew
  the license or registration.  The person may obtain a new license by
  complying with the requirements and procedures for obtaining an
  original license or registration.
         SECTION 4.  Not later than January 1, 2010, the Texas
  Commission of Licensing and Regulation shall adopt rules under
  Section 1302.101(f), Occupations Code, as added by this Act.
         SECTION 5.  (a)  The change in law made by this Act by the
  amendment of Section 1302.260, Occupations Code, applies only to a
  license issued or renewed on or after the effective date of this
  Act. A license issued or renewed before the effective date of this
  Act is governed by the law in effect on the date the license was
  issued or renewed, and the former law is continued in effect for
  that purpose.
         (b)  The change in law made by this Act by the enactment of
  Section 1302.2601(b), Occupations Code, applies only to a license
  or registration that expires on or after the effective date of this
  Act. A license or registration that expires before that date is
  governed by the law in effect on the date the license or
  registration expired, and the former law is continued in effect for
  that purpose.
         SECTION 6.  This Act takes effect September 1, 2009.
