A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a review by the commissioner of education of the |
|
|
instructional facilities allotment. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 46, Education Code, is |
|
|
amended by adding Section 46.0021 to read as follows: |
|
|
Sec. 46.0021. REVIEW OF SCHOOL FACILITIES ALLOTMENT. |
|
|
(a) The commissioner shall conduct a comprehensive review of the |
|
|
instructional facilities allotment provided under this subchapter |
|
|
to: |
|
|
(1) evaluate the effectiveness of the allotment in |
|
|
providing necessary financial assistance to school districts |
|
|
seeking to construct, acquire, renovate, or improve instructional |
|
|
facilities; and |
|
|
(2) consider the appropriateness of increasing the |
|
|
guaranteed level of state and local funds per cent of tax effort |
|
|
under Section 46.003. |
|
|
(b) Not later than January 1, 2011, the commissioner shall |
|
|
prepare and deliver to the lieutenant governor, the speaker of the |
|
|
house of representatives, and the presiding officer of each |
|
|
legislative standing committee with primary jurisdiction over |
|
|
primary and secondary education a report addressing the results of |
|
|
the commissioner's review and detailing any recommended changes to |
|
|
the instructional facilities allotment. |
|
|
(c) This section expires September 1, 2011. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
