A BILL TO BE ENTITLED
 
AN ACT
  relating to the sale or purchase of certain game.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sec. 62.021, Parks and Wildlife Code, is amended
  to read as follows:
         (a)  Except as provided by Subsection (c), no person may
  sell, offer for sale, purchase, offer to purchase, or possess after
  purchase a wild bird, game bird, or game animal, dead or alive, or
  part of the bird or animal.
         (b)  This section applies only to a bird or animal protected
  by this code without regard to whether the bird or animal is taken
  or killed in this state.
         (c)  This section does not prohibit the sale of:
               (1)  a live game animal, a dead or live game bird, or
  the feathers of a game bird if the sale is conducted under authority
  of a license or permit issued under this code; [or]
               (2)  an inedible part lawfully taken or possessed,
  including the feathers, bones, or feet of a non-migratory game
  bird; hair, hide, antlers, bones, hooves, horns, skulls, or sinew
  of a deer, pronghorn antelope, desert bighorn sheep, javelina, or
  red or gray squirrel; or
               (3)  the feathers of a migratory game bird in
  accordance with federal law.
         SECTION 2.  This Act takes effect September 1, 2009.
