A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a study by the Texas Commission on Environmental |
|
Quality of toxic air pollutants in this state. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. DEFINITION. In this Act, "commission" means the |
|
Texas Commission on Environmental Quality. |
|
SECTION 2. STUDY. (a) The commission shall conduct a study |
|
to identify the three toxic air contaminants with the highest |
|
emissions levels in this state. In conducting the study, the |
|
commission shall: |
|
(1) determine the main emission sources for each of |
|
the three toxic air contaminants; and |
|
(2) evaluate the effects of emissions for each of the |
|
toxic air contaminants on the public health. |
|
(b) The commission shall evaluate the data collected during |
|
the study and recommend strategies for reducing emissions levels |
|
for each of the toxic air contaminants identified by the study |
|
conducted under Subsection (a) of this section. |
|
SECTION 3. REPORT. Not later than December 1, 2010, the |
|
commission shall report the results and recommendations of the |
|
study conducted under this Act to the governor, the lieutenant |
|
governor, the speaker of the house of representatives, and the |
|
standing committees of the house of representatives and the senate |
|
with primary jurisdiction over environmental matters. |
|
SECTION 4. EXPIRATION. This Act expires January 1, 2011. |
|
SECTION 5. EFFECTIVE DATE. This Act takes effect |
|
immediately if it receives a vote of two-thirds of all the members |
|
elected to each house, as provided by Section 39, Article III, Texas |
|
Constitution. If this Act does not receive the vote necessary for |
|
immediate effect, this Act takes effect September 1, 2009. |
