A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to reports of certain information relating to foster homes |
|
by the Department of Family and Protective Services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 42, Human Resources Code, |
|
is amended by adding Section 42.0481 to read as follows: |
|
Sec. 42.0481. REPORT REGARDING WAIVERS GRANTED TO LICENSED |
|
FACILITIES. Not later than December 1 of each year, the department |
|
shall report to the lieutenant governor, the speaker of the house of |
|
representatives, and the standing committee of each house of the |
|
legislature with primary jurisdiction over child-care facilities: |
|
(1) the number of licenses for foster homes and foster |
|
group homes issued by the department for which the department |
|
granted a non-safety-related waiver; |
|
(2) the specific licensing requirements for which the |
|
department issued a non-safety-related waiver; |
|
(3) the number of relative caregivers whose homes |
|
would qualify to become a licensed foster home or foster group home |
|
without a non-safety-related waiver; and |
|
(4) the number of relative caregivers whose homes |
|
would qualify to become a licensed foster home or foster group home |
|
if granted a non-safety-related waiver. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
