A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to medical assistance reimbursement for prescriptions |
|
|
issued by certain health care providers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 32.024, Human Resources Code, is amended |
|
|
by adding Subsection (z-3) to read as follows: |
|
|
(z-3) Subject to Subsection (z), the department shall |
|
|
provide medical assistance reimbursement to a pharmacy or other |
|
|
health care provider for prescription drugs provided to a medical |
|
|
assistance recipient as authorized by a prescription issued to the |
|
|
recipient by a health care provider whose application for a medical |
|
|
assistance provider number is pending with the department. The |
|
|
executive commissioner of the Health and Human Services Commission |
|
|
may adopt rules as necessary under which the department will issue a |
|
|
temporary provider number to a health care provider on the |
|
|
provider's submission of an application for a permanent number. |
|
|
The temporary number may be used by the provider when issuing |
|
|
prescriptions subject to this subsection. |

|
SECTION 2. If before implementing any provision of this Act |
|
|
a state agency determines that a waiver or authorization from a |
|
|
federal agency is necessary for implementation of that provision, |
|
|
the agency affected by the provision shall request the waiver or |
|
|
authorization and may delay implementing that provision until the |
|
|
waiver or authorization is granted. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
