A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the administration of money provided to the state by the |
|
|
United States Department of Housing and Urban Development. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2306.071, Government Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) Notwithstanding any provision to the contrary, and to |
|
|
the extent permitted by federal law, the department is designated |
|
|
as the recipient and administrator of all money provided to the |
|
|
state by the United States Department of Housing and Urban |
|
|
Development. If another law permits an agency other than the |
|
|
department to administer a program that receives not less than 50 |
|
|
percent of the program's money from the United States Department of |
|
|
Housing and Urban Development, the program shall be transferred to |
|
|
the department and the department and the other agency shall enter |
|
|
into an agreement for the orderly transition of the program to the |
|
|
department. If another law permits an agency other than the |
|
|
department to administer a program that receives less than 50 |
|
|
percent of the program's money from the United States Department of |
|
|
Housing and Urban Development, the department and the other agency |
|
|
shall enter into a memorandum of understanding for the joint |
|
|
administration of the program. |

|
SECTION 2. This Act takes effect September 1, 2009. |
