A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the tourist-oriented directional sign program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 391.099, Transportation Code, is amended |
|
by amending Subsections (c) and (e) and adding Subsection (i) to |
|
read as follows: |
|
(c) Except as provided by Subsection (f), the commission |
|
shall: |
|
(1) regulate the content, composition, design, |
|
placement, erection, and maintenance of tourist-oriented |
|
directional signs and supports on eligible highway rights-of-way; |
|
(1-a) ensure that a tourist-oriented directional sign |
|
is placed in the designated area not more than 90 days after the |
|
date a contract between a contractor and an eligible facility is |
|
executed; |
|
(1-b) erect a general service sign, instead of a |
|
tourist-oriented directional sign, at the request of an eligible |
|
facility that is a recreational vehicle park or camping area at a |
|
cost to the facility not to exceed $250 for each sign; and |
|
(2) adopt rules necessary to administer and enforce |
|
this section. |
|
(e) A contract under this section shall provide for: |
|
(1) the assessment of fees to be paid to a contractor |
|
by an eligible facility based on the size of the facility as |
|
determined by the annual receipts of the facility; [and] |
|
(2) remittance to the department of the greater of: |
|
(A) 25 [10] percent of the fees collected by the |
|
contractor; or |
|
(B) an amount sufficient to recover the |
|
department's costs of administering the program; and |
|
(3) completion and placement of a tourist-oriented |
|
directional sign in a designated area not more than 90 days after |
|
the date a contract is executed between a contractor and an eligible |
|
facility. |
|
(i) Revenue received by the department under this section |
|
shall be used for annual destination studies that determine where |
|
tourists to this state reside. |
|
SECTION 2. Section 391.099, Transportation Code, as amended |
|
by this Act, applies only to a contract executed on or after the |
|
effective date of this Act. A contract executed before the |
|
effective date of this Act is governed by the law in effect |
|
immediately before that date, and the former law is continued in |
|
effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2009. |
