A BILL TO BE ENTITLED
 
AN ACT
  relating to the tourist-oriented directional sign program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 391.099, Transportation Code, is amended
  by amending Subsections (c) and (e) and adding Subsection (i) to
  read as follows:
         (c)  Except as provided by Subsection (f), the commission
  shall:
               (1)  regulate the content, composition, design,
  placement, erection, and maintenance of tourist-oriented
  directional signs and supports on eligible highway rights-of-way;
               (1-a) ensure that a tourist-oriented directional sign
  is placed in the designated area not more than 90 days after the
  date a contract between a contractor and an eligible facility is
  executed;
               (1-b) erect a general service sign, instead of a
  tourist-oriented directional sign, at the request of an eligible
  facility that is a recreational vehicle park or camping area at a
  cost to the facility not to exceed $250 for each sign; and
               (2)  adopt rules necessary to administer and enforce
  this section.
         (e)  A contract under this section shall provide for:
               (1)  the assessment of fees to be paid to a contractor
  by an eligible facility based on the size of the facility as
  determined by the annual receipts of the facility; [and]
               (2)  remittance to the department of the greater of:
                     (A)  25 [10] percent of the fees collected by the
  contractor; or
                     (B)  an amount sufficient to recover the
  department's costs of administering the program; and
               (3)  completion and placement of a tourist-oriented
  directional sign in a designated area not more than 90 days after
  the date a contract is executed between a contractor and an eligible
  facility.
         (i)  Revenue received by the department under this section
  shall be used for annual destination studies that determine where
  tourists to this state reside.
         SECTION 2.  Section 391.099, Transportation Code, as amended
  by this Act, applies only to a contract executed on or after the
  effective date of this Act. A contract executed before the
  effective date of this Act is governed by the law in effect
  immediately before that date, and the former law is continued in
  effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2009.
