A BILL TO BE ENTITLED
 
AN ACT
  relating to a strategy to ensure that public institutions of higher
  education employ faculty and staff who reflect the population of
  Texas.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 61, Education Code, is
  amended by adding Section 61.0861 to read as follows:
         Sec. 61.0861.  FACULTY AND STAFF RECRUITMENT AND RETENTION
  STRATEGY.  (a) The board shall develop and annually update a
  strategy to enable institutions of higher education to identify,
  attract, hire, and retain faculty and staff who reflect the
  population of this state.
         (b)  Each institution of higher education shall implement
  the elements of the strategy developed under Subsection (a)
  applicable to the institution as provided by the board. Each
  institution shall report annually to the board the manner in which
  the institution has implemented the applicable elements of the
  strategy.
         SECTION 2.  The Texas Higher Education Coordinating Board
  shall adopt the strategy required by Section 61.0861, Education
  Code, as added by this Act, not later than January 1, 2010.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
