A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to construction, acquisition, improvement, operation, and |
|
|
maintenance of toll projects by certain counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 284, Transportation Code, |
|
|
is amended by adding Section 284.014 to read as follows: |
|
|
Sec. 284.014. GENERAL RULEMAKING AUTHORITY. The |
|
|
commissioners court of a county to which this chapter applies shall |
|
|
adopt rules governing the implementation of this chapter, including |
|
|
rules relating to: |
|
|
(1) agreements with private entities for the |
|
|
financing, design, construction, or operation of a project; |
|
|
(2) the operation of a project, including rules |
|
|
regarding the amount of tolls charged, the method of collection of |
|
|
tolls, and the imposition of fines and administrative costs; |
|
|
(3) agreements with other public entities related to |
|
|
the financing, design, construction, or operation of a project; |
|
|
(4) acquisition of property for a project; and |
|
|
(5) the issuance of bonds for transportation projects. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
