A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to motor vehicle title services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 520.054(b), Transportation Code, is |
|
amended to read as follows: |
|
(b) An application must include: |
|
(1) the applicant's name, business address, and |
|
business telephone number; |
|
(2) the name under which the applicant will do |
|
business; |
|
(3) the physical address of each office from which the |
|
applicant will conduct business; |
|
(4) a statement indicating whether the applicant has |
|
previously applied for a license under this subchapter, the result |
|
of the previous application, and whether the applicant has ever |
|
been the holder of a license under this subchapter that was revoked |
|
or suspended; |
|
(5) information from the applicant as required by the |
|
county tax assessor-collector to establish the business reputation |
|
and character of the applicant; |
|
(6) the applicant's federal tax identification number; |
|
(7) the applicant's state sales tax number; [and] |
|
(8) a legible photocopy of the current driver's |
|
license, personal identification certificate, or official |
|
identification card issued to the applicant by this state, another |
|
state, or the United States, which must bear a photograph of the |
|
applicant; and |
|
(9) any other information required by rules adopted |
|
under this subchapter. |
|
SECTION 2. Section 520.062, Transportation Code, is amended |
|
by adding Subsection (c) to read as follows: |
|
(c) In this section, "convicted" means an adjudication of |
|
guilt or an order of deferred adjudication entered against a person |
|
by a court, regardless of whether the imposition of the sentence is |
|
subsequently probated and the person discharged from community |
|
supervision. The term does not include an adjudication of guilt or |
|
an order of deferred adjudication that has been subsequently: |
|
(1) expunged; or |
|
(2) pardoned under the authority of an official of |
|
this state or the United States. |
|
SECTION 3. (a) The change in law made by this Act to |
|
Section 520.054, Transportation Code, applies only to an |
|
application for a motor vehicle title service license that is filed |
|
on or after the effective date of this Act. An application for a |
|
motor vehicle title service license filed before the effective date |
|
of this Act is governed by the law in effect when the application |
|
was filed, and the former law is continued in effect for that |
|
purpose. |
|
(b) The change in law made by this Act to Section 520.057, |
|
Transportation Code, applies only to a transaction regulated by |
|
that section that occurs on or after the effective date of this Act. |
|
A transaction that occurred before the effective date of this Act is |
|
governed by the law in effect when the transaction occurred, and the |
|
former law is continued in effect for that purpose. |
|
SECTION 4. This Act takes effect September 1, 2009. |
