A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the enforcement of certain development regulations in a
  justice court.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 231.229(b), Local Government Code, is
  amended to read as follows:
         (b)  A person commits an offense if the person violates this
  subchapter or an order or development regulation adopted under this
  subchapter. An offense under this subsection is a misdemeanor
  punishable by a fine of not less than $500 or more than $1,000. Each
  day that a violation occurs constitutes a separate offense. Trial
  shall be in the justice [district] court.
         SECTION 2.  Section 231.229, Local Government Code, as
  amended by this Act, applies to an offense committed on or after the
  effective date of this Act. An offense committed before the
  effective date of this Act is governed by the law in effect when the
  offense was committed, and the former law is continued in effect for
  that purpose.
         SECTION 3.  This Act takes effect September 1, 2009.
