A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the enforcement of certain development regulations in a |
|
justice court. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 231.229(b), Local Government Code, is |
|
amended to read as follows: |
|
(b) A person commits an offense if the person violates this |
|
subchapter or an order or development regulation adopted under this |
|
subchapter. An offense under this subsection is a misdemeanor |
|
punishable by a fine of not less than $500 or more than $1,000. Each |
|
day that a violation occurs constitutes a separate offense. Trial |
|
shall be in the justice [district] court. |
|
SECTION 2. Section 231.229, Local Government Code, as |
|
amended by this Act, applies to an offense committed on or after the |
|
effective date of this Act. An offense committed before the |
|
effective date of this Act is governed by the law in effect when the |
|
offense was committed, and the former law is continued in effect for |
|
that purpose. |
|
SECTION 3. This Act takes effect September 1, 2009. |
