A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the procedures for certain honorably retired peace |
|
officers to maintain a license to carry a concealed handgun. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Sections 411.199(a) and (e), Government Code, |
|
are amended to read as follows: |
|
(a) A person who is licensed as a peace officer under |
|
Chapter 1701, Occupations Code, [Chapter 415] and who has been |
|
employed full-time as a peace officer by a law enforcement agency |
|
may apply for a license under this subchapter at any time after |
|
retirement. |
|
(e) A retired peace officer who obtains a license under this |
|
subchapter must maintain, for the category of weapon licensed, the |
|
proficiency required for a peace officer under Section 1701.355, |
|
Occupations Code [Section 415.035]. The department [or a local law
|
|
enforcement agency] shall allow a retired peace officer of the |
|
department [or agency] an opportunity to annually demonstrate the |
|
required proficiency. A local law enforcement agency shall allow a |
|
retired peace officer of the agency, or a retired peace officer who |
|
resides in the jurisdiction of the agency, an opportunity to |
|
annually demonstrate the required proficiency. The proficiency |
|
shall be reported to the department on application and renewal. |
|
SECTION 2. This Act takes effect September 1, 2009. |
