A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the coordination and administration of the Texas Career
  Opportunity Grant Program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 305, Labor Code, is
  amended by adding Section 305.003 to read as follows:
         Sec. 305.003.  MEMORANDUM OF UNDERSTANDING. The commission
  and the coordinating board shall enter into a memorandum of
  understanding for the coordination and administration of the grant
  program established under Subchapter B. Functions assigned to the
  commission under this chapter may be assigned to the coordinating
  board pursuant to the memorandum of understanding.
         SECTION 2.  The transfer to the Texas Higher Education
  Coordinating Board of any functions relating to the administration
  of the Texas Career Opportunity Grant Program pursuant to a
  memorandum of understanding entered into under Section 305.003,
  Labor Code, as added by this Act, applies beginning with grants
  awarded for the 2010 fall semester.  Grants awarded for an academic
  period before that semester are covered by the law in effect
  immediately before the effective date of this Act, and the former
  law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
