A BILL TO BE ENTITLED
 
AN ACT
  relating to reporting by registered lobbyists of compensation
  earned from and expenditures made in providing political consulting
  services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 305, Government Code, is
  amended by adding Section 305.0065 to read as follows:
         Sec. 305.0065.  COMPENSATION FROM PROVISION OF POLITICAL
  CONSULTING SERVICES.  (a)  In this section:
               (1)  "Political committee" has the meaning assigned by
  Section 251.001, Election Code.
               (2)  "Political consulting services" means:
                     (A)  consulting in relation to campaign strategy;
                     (B)  consulting or services in relation to
  campaign fund-raising;
                     (C)  voter demographics and polling;
                     (D)  campaign speech writing;
                     (E)  services related to political advertising;
  or
                     (F)  planning and scheduling of public campaign
  appearances.
         (b)  A registrant who provides political consulting services
  in connection with an actual or potential campaign of a candidate
  for or holder of an office of state government or to a political
  committee that supports, opposes, or assists one or more candidates
  for or holders of an office of state government, a political party,
  or a political committee established by a political party shall
  include in the report filed under Section 305.006, for each
  candidate, officeholder, political committee, or political party
  to whom the registrant provided political consulting services:
               (1)  the person's full name and address;
               (2)  the exact amount of compensation the registrant
  received from the person for providing the services; and
               (3)  for each expenditure the registrant made in
  connection with providing political consulting services provided
  to the person:
                     (A)  the full name and address of the person to
  whom the expenditure is made;
                     (B)  the amount of the expenditure; and
                     (C)  a description of the purpose of the
  expenditure, in the following categories:
                           (i)  services in relation to campaign
  fund-raising;
                           (ii)  voter demographics and polling;
                           (iii)  services related to political
  advertising; or
                           (iv)  planning and scheduling of public
  campaign appearances.
         (c)  A registrant who reports an expenditure under one
  category provided by Subsection (b)(3) may not report the same
  expenditure under another category of Subsection (b)(3).
         SECTION 2.  Section 305.0065, Government Code, as added by
  this Act, applies only to a report required to be filed under
  Section 305.006, Government Code, that is due on or after November
  10, 2009.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
