A BILL TO BE ENTITLED
 
AN ACT
  relating to energy and water conservation measures of state
  agencies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2166.406(c), Government Code, is amended
  to read as follows:
         (c)  Each energy or water conservation measure, including a
  measure undertaken by a state agency in the maintenance, repair, or
  construction of a building, including a building otherwise excepted
  from this chapter under Section 2166.003, that is implemented
  internally or through an energy savings performance contract must
  comply with current local, state, and federal construction,
  plumbing, and environmental codes and regulations. A plumbing
  fixture or technology or other material used for a water
  conservation measure under this subsection must provide the maximum
  amount of water savings. Notwithstanding Subsection (a), an energy
  savings performance contract may not include improvements or
  equipment that allow or cause water from any condensing, cooling,
  or industrial process or any system of nonpotable usage over which
  the public water supply system officials do not have sanitary
  control to be returned to the potable water supply.
         SECTION 2.  Section 2166.406, Government Code, as amended by
  this Act, applies only to an energy or water conservation measure
  undertaken by a state agency on or after January 1, 2010.
         SECTION 3.  This Act takes effect September 1, 2009.
