A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the creation of a publicly accessible electronic |
|
emissions database. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 382.014, Health and Safety Code, is |
|
amended to read as follows: |
|
Sec. 382.014. ELECTRONIC EMISSIONS DATABASE [EMISSION
|
|
INVENTORY]. (a) The commission shall [may] require a person who |
|
holds a permit issued under this chapter [whose activities cause
|
|
emissions of air contaminants] to annually submit information |
|
relating to: |
|
(1) permitted emissions; and |
|
(2) annual routine emissions associated with the |
|
permit [to enable the commission to develop an inventory of
|
|
emissions of air contaminants in this state]. |
|
(b) The information submitted under Subsection (a) must be |
|
compiled into an existing online database such as the State of Texas |
|
Environmental Electronic Reporting System. Information submitted |
|
under this section must be: |
|
(1) publicly accessible; and |
|
(2) searchable by permit number. |
|
(c) The commission shall: |
|
(1) assess the emissions information received under |
|
this section annually; and |
|
(2) not later than December 1 of each year, submit to |
|
the governor, lieutenant governor, and speaker of the house of |
|
representatives a report of the assessment conducted under this |
|
subsection. |
|
SECTION 2. The Texas Commission on Environmental Quality |
|
shall develop and implement the electronic database required under |
|
Section 382.014, Health and Safety Code, as amended by this Act, not |
|
later than January 1, 2010. |
|
SECTION 3. (a) Except as provided by Subsection (b) of |
|
this section, this Act takes effect September 1, 2009. |
|
(b) Section 382.014(c), Health and Safety Code, as added by |
|
this Act, takes effect January 1, 2010. |
