A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the creation of a comprehensive emissions database. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Section 382.014, Health and |
|
Safety Code, is amended to read as follows: |
|
ELECTRONIC EMISSION INVENTORY DATABASE |
|
SECTION 2. Section 382.014, Health and Safety Code, is |
|
amended to read as follows: |
|
(a) The commission shall develop a single, comprehensive |
|
electronic database of all emissions that shall centrally track all |
|
authorized and reported emissions activities and collect |
|
information relating to: |
|
(A) permitted emissions; |
|
(B) annual routine emissions; |
|
(C) excess emissions occurring during |
|
maintenance activities, including startups and shutdowns; and |
|
(D) and emissions resulting from emissions |
|
events. |
|
(b) The commission shall develop the capacity and shall |
|
incorporate all authorized and reported emissions into a permanent |
|
centralized database for emissions. The commission shall develop a |
|
mechanism whereby the reporting entity shall be allowed to review |
|
the information relative to its reported emissions prior to such |
|
information being included in the database. The database shall be |
|
accessible to the public. |
|
(c) The commission annually shall assess the information |
|
received under this section, including emissions, and shall include |
|
the assessment in the report required by Section 5.126, Water Code. |
|
(d) The commission may require a person whose activities |
|
cause emissions of air contaminants to submit information to enable |
|
the commission to develop an inventory of emissions of air |
|
contaminants in this state. |
|
SECTION 3. This Act takes effect September 1, 2009. |
