A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation by the Texas Commission on Environmental
  Quality of an inventory of emissions of air contaminants from oil or
  gas production, transportation, or processing facilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0146 to read as follows:
         Sec. 382.0146.  OIL OR GAS FACILITY EMISSIONS INVENTORY.
  (a) The commission shall develop and maintain an inventory of
  major, minor, area, and fugitive air contaminant emissions from oil
  and gas industry sources.
         (b)  The commission shall require an owner or operator of an
  oil or gas production, transportation, or processing facility that
  emits air contaminants to annually submit emissions estimates and
  other information necessary for the commission to develop and
  maintain the inventory.
         (c)  The commission may prescribe reasonable requirements
  for:
               (1)  measuring, monitoring, or estimating the
  emissions of air contaminants from an oil or gas production,
  transportation, or processing facility; and
               (2)  the owner or operator of an oil or gas production,
  transportation, or processing facility to make and maintain records
  on the measuring, monitoring, or estimating of emissions of air
  contaminants from the facility.
         (d)  A member, employee, or agent of the commission may
  examine during regular business hours any records or memoranda
  relating to the emissions of air contaminants from an oil or gas
  production, transportation, or processing facility.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2010.
