A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the review of certain drugs prescribed to a child in the |
|
conservatorship of the Department of Family and Protective |
|
Services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 266, Family Code, is |
|
amended by adding Section 266.0065 to read as follows: |
|
Sec. 266.0065. REVIEW OF CERTAIN MEDICATIONS PRESCRIBED TO |
|
CHILD. (a) In this section, "psychotropic drug" means a substance |
|
that is: |
|
(1) used in the diagnosis, treatment, or prevention of |
|
a disease or as a component of a medication; and |
|
(2) intended to have an altering effect on perception, |
|
emotion, or behavior. |
|
(b) If a child in the managing conservatorship of the |
|
department is prescribed three or more psychotropic drugs, the |
|
department shall refer the child's case to the Health and Human |
|
Services Commission to be reviewed by a physician other than the |
|
physician treating the child. |
|
(c) The physician reviewing the case shall determine |
|
whether the child's medical treatment is consistent with standards |
|
of care for a patient diagnosed with the child's mental disorder or |
|
documented symptoms. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
