A BILL TO BE ENTITLED
 
AN ACT
  relating to the review of certain drugs prescribed to a child in the
  conservatorship of the Department of Family and Protective
  Services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 266, Family Code, is
  amended by adding Section 266.0065 to read as follows:
         Sec. 266.0065.  REVIEW OF CERTAIN MEDICATIONS PRESCRIBED TO
  CHILD.  (a)  In this section, "psychotropic drug" means a substance
  that is:
               (1)  used in the diagnosis, treatment, or prevention of
  a disease or as a component of a medication; and
               (2)  intended to have an altering effect on perception,
  emotion, or behavior.
         (b)  If a child in the managing conservatorship of the
  department is prescribed three or more psychotropic drugs, the
  department shall refer the child's case to the Health and Human
  Services Commission to be reviewed by a physician other than the
  physician treating the child.
         (c)  The physician reviewing the case shall determine
  whether the child's medical treatment is consistent with standards
  of care for a patient diagnosed with the child's mental disorder or
  documented symptoms.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
