A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to itemized statements provided by certain health care |
|
|
facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 324.101, Health and Safety Code, is |
|
|
amended by adding Subsection (j) to read as follows: |
|
|
(j) An itemized statement provided as required by this |
|
|
section must: |
|
|
(1) include the unit price billed for: |
|
|
(A) any medical hardware provided by the |
|
|
facility; |
|
|
(B) each device or implant provided by the |
|
|
facility; and |
|
|
(C) any prescription specialty drug or drug |
|
|
protocol dispensed by the facility; and |
|
|
(2) to the extent the unit price reflects a discount, |
|
|
rebate, or other adjustment to the price paid by the facility, be |
|
|
accompanied by sufficient documentation to support the unit price |
|
|
charged. |
|
|
SECTION 2. Section 324.101, Health and Safety Code, as |
|
|
amended by this Act, applies only to an itemized statement for |
|
|
services or supplies provided by a health care facility to a |
|
|
consumer on or after the effective date of this Act. An itemized |
|
|
statement for services or supplies provided before the effective |
|
|
date of this Act is governed by the law in effect immediately before |
|
|
the effective date of this Act, and that law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
