A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
Relating to closure of a roadway or lane during times of emergency. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Section 545, Transportation Code is amended by |
|
|
adding Section 545.158 to read as follows: |
|
|
Section 545.158. Power of a fire department officer. (1) |
|
|
An officer of a fire department, in performance of his or her |
|
|
official duties, has the authority to close to traffic highway or |
|
|
other roadway, as necessary to protect the safety of persons or |
|
|
property. |
|
|
(2) In order to promote the safe implementation of |
|
|
this statute, the fire department officer shall utilize an official |
|
|
fire department vehicle using visual signals that meet the |
|
|
requirements of Sections 547.305 and 547.702, Transportation Code. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
