A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to suspending the goal for renewable energy. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.904, Utilities Code, is amended by |
|
|
amending Subsection (n) to read as follows: |
|
|
(n) Notwithstanding any other provision of law, the |
|
|
commission shall have the authority to cap the price of renewable |
|
|
energy credits and may suspend the goal contained in Subsection (a) |
|
|
if such suspension is necessary to protect the reliability and |
|
|
operation of the grid. The commission shall suspend the goal |
|
|
contained in subsection (a) if a national renewable portfolio |
|
|
standard is enacted under federal law and such standard would, when |
|
|
combined with the goal in subsection (a), increase costs to |
|
|
consumers in this state. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
