A BILL TO BE ENTITLED
 
AN ACT
  relating to suspending the goal for renewable energy.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.904, Utilities Code, is amended by
  amending Subsection (n) to read as follows:
         (n)  Notwithstanding any other provision of law, the
  commission shall have the authority to cap the price of renewable
  energy credits and may suspend the goal contained in Subsection (a)
  if such suspension is necessary to protect the reliability and
  operation of the grid.  The commission shall suspend the goal
  contained in subsection (a) if a national renewable portfolio
  standard is enacted under federal law and such standard would, when
  combined with the goal in subsection (a), increase costs to
  consumers in this state.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
