A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the permissible sources of funding for memorial markers
  to designate the Veterans Memorial Highway.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 225.059(d), Transportation Code, as
  added by Chapter 546 (H.B. 1136), Acts of the 79th Legislature,
  Regular Session, 2005, is amended to read as follows:
         (d)  The department is not required to design, construct, or
  erect a marker under this section unless a grant or donation of
  public funds, private funds, or both is made to the department to
  cover the cost of the design, construction, and erection of the
  marker.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
