A BILL TO BE ENTITLED
 
AN ACT
  relating to county transportation access plans.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 615, Local Government Code, is amended
  by adding a new subchapter E to read as follows:
  SUBCHAPTER E.  COUNTY TRANSPORTATION ACCESS PLANS
         Sec. 615.201  APPLICABILITY.  This subchapter applies to the
  approval, issuance, or renewal of a license, permit, or
  registration under the provisions of the Health and Safety Code,
  the Natural Resources Code, or the Water Code for any location
  within the unincorporated area of a county.
         Sec. 615.202  ACCESS PLAN REQUIRED.  Before the approval,
  issuance, or renewal of a license, permit, or registration subject
  to this subchapter, an access plan approved by the county shall be
  filed with the reviewing agency.
         Sec. 615.203  ADDITIONAL COSTS RECOVERY.  The access plan
  shall provide for recovery by the county for any additional costs to
  the county for construction or maintenance of county roads for
  access to the licensed, permitted or registered site.  The
  additional costs, if any, shall be determined by an analysis
  completed by an independent licensed professional engineer.
         Sec. 615.204  WAIVER.  By order of the commissioners court, a
  county may waive the requirements of this subchapter.
         SECTION 2.  This Act takes effect September 1, 2009.
