A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of exercise equipment to certain |
|
|
recipients of medical assistance. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 32.024, Human Resources Code, is amended |
|
|
by adding Subsection (kk) to read as follows: |
|
|
(kk) To the extent allowed by federal law, the department |
|
|
shall provide reimbursement under the medical assistance program |
|
|
for the purchase or rental of exercise equipment by a recipient of |
|
|
medical assistance diagnosed as having diabetes. The executive |
|
|
commissioner of the Health and Human Services Commission shall |
|
|
adopt rules defining items considered "exercise equipment" for |
|
|
purposes of this subsection. |
|
|
SECTION 2. The executive commissioner of the Health and |
|
|
Human Services Commission shall adopt the rules required by Section |
|
|
32.024(kk), Human Resources Code, as added by this Act, as soon as |
|
|
possible after the effective date of this Act. |
|
|
SECTION 3. If before implementing any provision of this Act |
|
|
a state agency determines that a waiver or authorization from a |
|
|
federal agency is necessary for implementation of that provision, |
|
|
the agency affected by the provision shall request the waiver or |
|
|
authorization and may delay implementing that provision until the |
|
|
waiver or authorization is granted. |
|
|
SECTION 4. This Act takes effect September 1, 2009. |
