A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to motor vehicle emissions inspections for certain salvage |
|
|
vehicles. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 548, Transportation Code, |
|
|
is amended by adding Section 548.308 to read as follows: |
|
|
Sec. 548.308. CERTAIN SALVAGE VEHICLES. (a) This section |
|
|
applies only to a motor vehicle to be titled or registered in a |
|
|
county with a motor vehicle emissions inspection and maintenance |
|
|
program. |
|
|
(b) Notwithstanding other provisions of this subchapter, a |
|
|
salvage vehicle for which a certificate of title is applied for |
|
|
under Section 501.100 shall be required to pass an acceleration |
|
|
simulation mode (ASM2) test or two-speed idle (TSI) test, instead |
|
|
of an on-board diagnostic II (OBDII) test, if the vehicle undergoes |
|
|
the on-board diagnostic II (OBDII) test and the results indicate |
|
|
that the vehicle has not completed a drive cycle. |
|
|
(c) A motor vehicle for which a regular certificate of title |
|
|
is issued under Section 501.100 is required to pass the regular |
|
|
approved vehicle emissions test for the county in which it is to be |
|
|
registered. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
