A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to certain contracts by certain governmental entities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sec. 403.0305, Government Code is amended to |
|
|
read as follows: |
|
|
Sec. 403.0305. LEGAL FEES[APPROVAL BY COMPTROLLER]. A |
|
|
public agency as defined under Section 30.003(3), Water Code, is |
|
|
free to contract for legal fees on any basis allowed pursuant to |
|
|
Rule 1.04, State Bar Rules of Professional Conduct[may not enter
|
|
|
into a contract as provided by Subchapter C, Chapter 2254, without
|
|
|
review and approval by the comptroller]. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
