A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating municipal and county financing of the acquisition of |
|
buffer areas or open spaces adjacent to a military installation for |
|
certain purposes. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 280, Local Government Code, is amended |
|
by adding Section 280.005 to read as follows: |
|
Sec. 280.005. ACQUISITION OF BUFFER AREA ADJACENT TO |
|
MILITARY INSTALLATION AUTHORIZED. A municipality or county may |
|
issue bonds or notes, including tax increment bonds or notes |
|
authorized under Chapter 311, Tax Code, to finance the acquisition |
|
of buffer areas or open spaces adjacent to a military installation |
|
for the prevention of encroachment or for the construction of |
|
roadways, utilities, or other infrastructure to protect or promote |
|
the mission of the military installation. |
|
SECTION 2. This Act takes effect December 1, 2009, but only |
|
if the constitutional amendment proposed by the 81st Legislature, |
|
Regular Session, 2009, authorizing the financing, including |
|
through tax increment financing, of the acquisition by |
|
municipalities and counties of buffer areas or open spaces adjacent |
|
to a military installation for the prevention of encroachment or |
|
for the construction of roadways, utilities, or other |
|
infrastructure to protect or promote the mission of the military |
|
installation is approved by the voters. If that amendment is not |
|
approved, this Act has no effect. |
