A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to municipal and county financing of the acquisition of |
|
|
buffer areas or open spaces adjacent to a military installation for |
|
|
certain purposes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 280, Local Government Code, is amended |
|
|
by adding Section 280.005 to read as follows: |
|
|
Sec. 280.005. ACQUISITION OF BUFFER AREA ADJACENT TO |
|
|
MILITARY INSTALLATION AUTHORIZED. A municipality or county may |
|
|
issue bonds or notes to finance the acquisition of buffer areas or |
|
|
open spaces adjacent to a military installation for the prevention |
|
|
of encroachment or for the construction of roadways or |
|
|
infrastructure to protect or promote the mission of the military |
|
|
installation. |

|
SECTION 2. This Act takes effect December 1, 2009, but only |
|
|
if the constitutional amendment proposed by the 81st Legislature, |
|
|
Regular Session, 2009, authorizing municipalities and counties to |
|
|
issue bonds and notes to finance the acquisition of buffer areas or |
|
|
open spaces adjacent to a military installation for the prevention |
|
|
of encroachment or for the construction of roadways or |
|
|
infrastructure to protect or promote the mission of the military |
|
|
installation, is approved by the voters. If that amendment is not |
|
|
approved, this Act has no effect. |
