A BILL TO BE ENTITLED
 
AN ACT
  relating to municipal and county financing of the acquisition of
  buffer areas or open spaces adjacent to a military installation for
  certain purposes.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 280, Local Government Code, is amended
  by adding Section 280.005 to read as follows:
         Sec. 280.005.  ACQUISITION OF BUFFER AREA ADJACENT TO
  MILITARY INSTALLATION AUTHORIZED. A municipality or county may
  issue bonds or notes to finance the acquisition of buffer areas or
  open spaces adjacent to a military installation for the prevention
  of encroachment or for the construction of roadways or
  infrastructure to protect or promote the mission of the military
  installation.
         SECTION 2.  This Act takes effect December 1, 2009, but only
  if the constitutional amendment proposed by the 81st Legislature,
  Regular Session, 2009, authorizing municipalities and counties to
  issue bonds and notes to finance the acquisition of buffer areas or
  open spaces adjacent to a military installation for the prevention
  of encroachment or for the construction of roadways or
  infrastructure to protect or promote the mission of the military
  installation, is approved by the voters. If that amendment is not
  approved, this Act has no effect.
