A BILL TO BE ENTITLED
 
AN ACT
  relating to the purchase of copper parts by air conditioning and
  refrigeration contractors and technicians; providing a criminal
  penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 1302, Occupations Code, is
  amended by adding Section 1302.264 to read as follows:
         Sec. 1302.264.  PURCHASE OF COPPER PARTS.  (a)  When removing
  copper parts, a person licensed or registered under this chapter
  must provide the owner of those parts with documentation showing
  that the parts were lawfully removed by the person acting under the
  authority of the owner.
         (b)  A person who purchases copper parts without obtaining
  from the seller a copy of the documentation required to be provided
  under this section commits an offense.  An offense under this
  section is a Class A misdemeanor.
         SECTION 2.  This Act takes effect September 1, 2009.
