A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the purchase of copper parts by air conditioning and |
|
|
refrigeration contractors and technicians; providing a criminal |
|
|
penalty. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 1302, Occupations Code, is |
|
|
amended by adding Section 1302.264 to read as follows: |
|
|
Sec. 1302.264. PURCHASE OF COPPER PARTS. (a) When removing |
|
|
copper parts, a person licensed or registered under this chapter |
|
|
must provide the owner of those parts with documentation showing |
|
|
that the parts were lawfully removed by the person acting under the |
|
|
authority of the owner. |
|
|
(b) A person who purchases copper parts without obtaining |
|
|
from the seller a copy of the documentation required to be provided |
|
|
under this section commits an offense. An offense under this |
|
|
section is a Class A misdemeanor. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
