A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the selection of the presiding officer of the Texas |
|
|
Medical Board. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 152.008, Occupations Code, is amended to |
|
|
read as follows: |
|
|
Sec. 152.008. OFFICERS. (a) Not later than December after |
|
|
each regular session of the legislature, the governor shall appoint |
|
|
from the members of the board a president, to serve in that capacity |
|
|
at the pleasure of the governor. Notwithstanding any other law or |
|
|
rule, any member of the board is eligible for appointment as |
|
|
president of the board under this subsection. |
|
|
(b) The [, and the] board shall elect from its members a vice |
|
|
president, secretary-treasurer, and other officers as are |
|
|
required, in the board's opinion, to carry out the board's duties. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
