A BILL TO BE ENTITLED
 
AN ACT
  relating to an adjustment to the amounts of revenue provided under
  the public school finance system to school districts located in
  certain counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 42, Education Code, is
  amended by adding Section 42.2525 to read as follows:
         Sec. 42.2525.  ADJUSTMENT FOR DISTRICTS IN CERTAIN COUNTIES.
  (a) In this section, "weighted average daily attendance" has the
  meaning assigned by Section 42.302.
         (b)  For each county with a population of at least three
  million, the commissioner shall:
               (1)  identify the district located entirely or
  partially in the county that is entitled under this chapter to the
  greatest amount of state and local revenue per student in weighted
  average daily attendance of any district located entirely or
  partially in the county; and
               (2)  for each other district located entirely or
  partially in the county that imposes a maintenance and operations
  tax at a rate at least equal to the rate imposed by the district
  identified under Subdivision (1), adjust the amount to which the
  other district is entitled under this chapter as necessary to
  provide that district with an amount of state and local revenue per
  student in weighted average daily attendance equal to the amount to
  which the district identified under Subdivision (1) is entitled.
         (c)  The amount to which a district is entitled under this
  section is in addition to the amount to which the district is
  entitled under Section 42.2516.
         (d)  A determination by the commissioner under this section
  is final and may not be appealed.
         SECTION 2.  This Act takes effect September 1, 2009.
