A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to allowing certain landowners to request that land be |
|
|
decertified from the service area of a holder of a certificate of |
|
|
public convenience and necessity. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 13.254, Water Code, is amended by adding |
|
|
Subsection (a-5) to read as follows: |
|
|
(a-5) Notwithstanding any other provision of this section, |
|
|
the owner of a tract of land that is at least 300 acres and that is |
|
|
located within the certificated area of a certificate holder may |
|
|
request that the commission decertify the land, if the certificate |
|
|
holder does not provide retail water and sewer service to the land. |
|
|
The commission shall grant a landowner's request under this |
|
|
subsection on receipt of the request. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
