A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of Harris County probate judges to sign |
|
orders and act on each other's behalf in the event of their absence, |
|
disqualification, or incapacity. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 15.1034, Texas Government Code, is |
|
amended by adding Subsection (n) to read as follows: |
|
(n) A Harris County statutory probate judge may sit and act |
|
on behalf of any other Harris County statutory probate judge who is |
|
unavailable to serve due to absence, disqualification, incapacity, |
|
or for any other reason, in any Harris County probate court |
|
courtroom, in any matter or proceeding pending in any Harris County |
|
statutory probate court. A Harris County statutory probate court |
|
judge may sign any orders in any matter or proceeding that the judge |
|
of any other Harris County statutory probate court may sign. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
